Definitions

In these terms and conditions the following terms shall have the following meanings

Content" means any pictures, graphics software, data, information, and other materials published or made available on the website, including the Third Party Content and any user generated

Voucher means any vouchers used by you the customer to redeem Goods or Services in a Deal.

Goods means any goods that are offered by a Merchant

Deal means the Goods and / or Services being offered by a Merchant at a discounted rate and promoted through our Website.

User means a person that has completed our registration process and created an account.

Merchants  mean any participating seller, vendor, trader or dealer that has agreed to make Goods or Services available to Members at a discounted rate via our website

Redemption Level" means the minimum number of customers that are required to have made an offer to buy Goods or Services before a Deal can be confirmed and a voucher can be redeemed.

Services means any services that are offered by a Merchant.

Subscriber  means a user that has signed up to receive email communications about bagadelal.ie

"We", "us" and "our" are a reference to www.bagadeal.ie

"You" and "your" are a reference to you as a customer

If you do not wish to agree to these terms then you must cease to use Our Site

All applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. Our Service

We act as an agent to the merchant only and do not have any contractual relationship with the user.

Terms of use

To use the service and make a purchase you must be 18 years of age or over.

All vouchers are promotional vouchers that are offered for purchase at a discount price and are subject to any terms, restrictions and conditions associated with the respective deal.

For verification purposes each voucher shall bear a sequential number and a security number.

All Vouchers shall contain a redemption period on the face of the voucher and/or on the Website at the time of the promotion of the Deal, during which time the customer can redeem the voucher for the voucher products at the discount price. If your voucher is past the redemption period set out at the time of the promotion of the deal, it shall be deemed to have expired.

If you choose to reserve a voucher advertised on the Website you will need to complete the necessary steps as per the instructions set out on the Website. On entering your payment details, you authorise us to charge you for the cost of the deal, but this does not constitute any obligation on our part to sell you a voucher or voucher product.

We will process your payment details immediately. A contract for purchase of the voucher products shall only be made between you and the merchant when we email you confirming the purchase has been completed

Once the deal is closed, the voucher shall be redeemable by you from the Merchant for the specified voucher products during the redemption period specified on the Voucher

The merchant will honor its obligation to provide voucher products upon the presentation of the voucher by you, other than in the event of fraud or where that redemption would breach applicable laws and where the terms of the voucher as indicated at the time of purchase are not fulfilled.

The seller of the Voucher Products

Solely responsible for redeeming any voucher you purchase

Solely responsible for supplying the voucher products to you in accordance with the description provided on the Voucher and for the voucher products themselves.

Bagadeal.ie does not accept any responsibility for any purchase made through the website that is deemed unsatisfactory after redemption.

Neither Bagadeal.ie nor the Merchant are responsible for lost or stolen Vouchers. You should treat the Voucher and the Voucher security number as cash. No replacement Voucher can be issued in respect of lost or stolen Vouchers.

You agree that you will abide by the terms of the deal and the terms and conditions of the merchant in respect of any vouchers which you choose to purchase

Operation of Website

We provide a group purchasing service. This service consists of us identifying merchants who are willing to offer discounted prices for goods or services if certain volumes of goods or services are purchased. We work with the merchants to agree a price linked to volume which we believe will appeal to subscribers and members and then promote these deals to our subscribers and members. Once a deal is purchased, the payment is debited from the users account. We then co-ordinate the collection of money for the Merchants and issue vouchers which can be redeemed for the Goods or Services to users who have offered to purchase the Goods or Services. The Website is a tool through which we deliver that service.
If you wish to receive email communications about deals you will need to agree to the Subscriber Terms. If you wish to purchase a deal you will need to complete the member registration process and agree to the membership terms.

Registration

To purchase the deals on our Website you must be over 18 years of age

To view the deals on Our Website you must register using a valid e-mail address.

To purchase a voucher from our website you must provide us with your name, e-mail address and relevant payment details as set out on the form.

You must provide us with a valid personal e-mail address if the address is deemed invalid we will be unable to proceed with the purchase.

When you make a purchase you will be asked to create a password. You must not disclose the password to any other person and must tell us immediately if you suspect there is any unauthorised use of your password. It is your responsibility to protect the confidentiality of your password.

Use of License

Returns and Refund Policy

Can I return my Bagadeal Voucher?
Once you have purchased a deal you are committed to the transaction and your credit card will be charged immediately. Except where we are required to under law, we do not give refunds or allow exchanges.

What if the business for my Bagadeal Voucher closes down or does not honor my Bagadeal Voucher?
If a business that is supposed to provide goods or services to you under a deal closes down, you will need to contact the merchant directly to redeem a refund.

Cancellation Policy
You may cancel the Bag A Deal transaction at any time within 7 days of purchasing the voucher. The cooling off period is not applicable where you have already redeemed the voucher in question. Refunds will be credited to your original method of payment. You can email info@bagadeal.ie

The Bag A Deal refund will not apply if a business's refusal to provide a service is because the Universal Fine Print or the Fine Print has not been complied with. For example, you will not receive a refund for the following:

 If a restaurant does not honor a Bag A Deal voucher that you have given to a friend who is under18 years old, and your friend tries to redeem that Bag A Deal Voucher for alcohol.

If you have given your friends or family a Bag A Deal voucher and they cannot redeem the Bag A Deal Voucher for the reasons mentioned above, we will give the refund to you and not your friends/family.

We will not be liable for any other loss or damage incurred by you, and/or any person that you give the Bag A Deal voucher to, as a result of a business's failure to honor your Bag A Deal voucher. For example, if you incur cost’s travelling to the business where the services in a Bag A Deal would have been provided, we will not be responsible for those costs.
